LIABILITY , SAFETY RULES AND GUIDELINES, PAYMENT, DEPOSITS, EQUIPMENT CARE, CANCELATIONS AND PENALTIES​

Age Restrictions

You must be at least 18 years old to rent a jet ski from Miami Jet Ski Club.

(with 16+ sometimes allowed with parental consent).

1. Eligibility Requirements

1.1. Temporary Boating Certificate:

  • Participants born in or after 1988 who wish to rent a Jet Ski in Florida and do not possess a boater’s safety card, also known as a Lifetime Boating License, are required to take the Boater Test to obtain a Florida Temporary Boating Certificate. The certificate is valid for 90 days, and the test can be taken multiple times. The fee for the test is $13.95. 1.2. Driver License & Credit Card

  • To ensure a smooth rental process, we kindly ask all customers to present a valid government-issued ID or driver's license, and the company requires that the name on the driver's license matches the name on the credit card provided at the time of rental.

1.3. Contract & Waiver:

  • Signing a rental contract and waiver is required prior to taking possession of the jet ski.

1.5. Security Deposit: 

  • A refundable security deposit of $100 USD is required at the time of rental, covering potential damages, lost equipment, or rule violations, and will be processed through a credit card pre-authorization form. The deposit will be refunded within 3 to 10 business days after the jet ski has been inspected and all terms of the rental agreement have been met. If damages exceed the deposit amount, the renter agrees to cover the remaining repair or replacement costs to restore the watercraft to its original condition.

1.4. Reservation Deposit

  • To secure and confirm your reservation, the company requires a deposit equivalent to 25% of the total rental cost.

2. Safety Briefing and Training

​Emergency protocols for jet ski rentals are essential for ensuring safety in case of accidents, equipment failure, or other unforeseen incidents. Here are common emergency procedures that we have in place:

2.1. Pre-rental Safety Briefing:

  • Safety Instructions: All renters will receive a thorough briefing from an instructor on how to operate the jet ski, including how to handle emergencies.

  • Emergency Contact Information: Renters should be given a phone number or radio frequency to contact the rental company in case of emergency or breakdown.

  • Cell Phone or Smart Phone: ​A phone is required with at least 70% of battery to insure and stay communicate with a water proof phone case.​​​

2.2. Life Jackets & Safety Equipment:

  • Mandatory Life Jackets: All riders are usually required to wear life jackets at all times.

  • Whistle or Sound Signal: A sound device like a whistle is often provided to signal distress in case of emergency.

  • Safety Lanyard: The jet ski should be equipped with a lanyard (kill switch), which cuts off the engine if the rider falls off.

2.3. Designated Riding Area:

 

  • Stay in the Approved Area: "Miami Jetski Club" will specify a designated area for riding, and straying outside that zone is discouraged for safety reasons.

  • Monitoring: "Miami Jetski Club" monitors jet skis via GPS or have patrol boats in the area to assist if someone is in trouble.

2.4. Accident or Injury Protocol:

  • Call for Help: If an accident occurs, the rider should immediately signal for help using the provided communication device or whistle.

  • Return to Shore: If safe and possible, attempt to return to the rental base or the nearest shore.

  • Medical Assistance: If there are injuries, call 911 or notify the rental company, who can coordinate emergency medical assistance.

2.5. Jet Ski Malfunction:

  • Stop and Assess: If the jet ski malfunctions, stop riding and try to assess the issue. Many companies advise checking fuel, the engine, or tangled debris.

  • Call the Rental Company: Contact the company for assistance if you cannot resolve the issue. They may provide instructions or sent a rescue team.

2.6. Weather Changes:

  • Return to Shore: If you notice sudden weather changes, such as strong winds or storms, return to shore immediately.

  • Emergency Docking: If conditions become dangerous before you can return, head to the rearest safe docking point and contact the rental company.

2.7. Capsizing or Falling Off:

  • Re-board Safely: Most jet skis are designed to be righted if capsized. Follow the instructions given during the safety briefing to re-board.

  • Stay with the Jet Ski: If you cannot re-board, stay with the jet ski, as it provides flotation and is easier to spot by rescuers.

2.8. Loss of Rider:

  • Signal for Help: If someone falls off the jet ski and can't be located immediately, the remaining rider should stay in the area and signal for help.

  • Alert Authorities: Contact the rental company or coast guard if the person cannot be located quickly.

Having these protocols in place ensures the safety of the riders and prevents small incidents from turning into larger emergencies. Always ask the rental company for their specific safety and emergency procedures.

3. Prohibited Activities

When renting a jet ski, there are typically several prohibited activities outlined by the rental company to ensure the safety of the rider, others on the water, and the equipment itself. Common prohibited activities include:

 

3.1. Operating Under the Influence

  • No Alcohol or Drugs: Operating a jet ski while intoxicated or under the influence of drugs is illegal and extremely dangerous.

3.2. Reckless Driving

  • Speeding in Restricted Areas: Excessive speed in no-wake zones or near swimmers, docks, or other boats is usually prohibited.

  • Sharp Turns and Stunts: Engaging in sharp turns, jumps over waves, or other stunts that could lead to loss of control or accidents is often banned.

   

3.3. Towing Without Permission

  • No Unapproved Towing: Using the jet ski to tow other riders, inflatables, or water skiers without the rental company's approval is typically prohibited.

3.4. Exceeding Passenger Limits

  • Overloading: Riding with more passengers than the jet ski is designed to carry (usually two or three people) is forbidden for safety reasons.

3.5. Entering Restricted Areas

  • Protected Zones: Riding in environmentally protected areas, such as wildlife refuges, or areas designated off-limits by the rental company or local regulations is usually not allowed.

  • Private or Unauthorized Waters: Entering private waterways or areas where jet skis are prohibited is often restricted.

3.6. Operating in Poor Weather Conditions

  • Bad Weather: Riding during severe weather, such as storms, high winds, or low visibility conditions, is usually prohibited.

3.7. Ignoring Safety Devices

  • Not Wearing Life Jackets: Riders are required to wear life jackets at all times while on the jet ski.

  • Disabling Kill Switch: Removing or tampering with the kill switch lanyard, which stops the jet ski if the rider falls off, is forbidden.

 

3.8. Riding After Dark

  • Night Riding: Jet skiing after dark is typically prohibited, as it is difficult to see hazards and other vessels in low light conditions.

 

3. 9. Leaving Designated Areas

  • Going Out of Boundaries: Straying outside of the approved or designated riding area set by the rental company is often prohibited for safety reasons.

 

3.10. Collisions or Unsafe Proximity to Others

  • Tailgating or Aggressive Riding: Riding too closely to other jet skis, boats, or people in the water can lead to accidents and is usually prohibited.

3.11. Engaging in Commercial Activities

  • Unauthorized Business Use: Using a rented jet ski for any form of commercial activity, such as offering rides for money, without approval from the rental company is typically forbidden.

 

3.12. Tampering with Equipment

  • Modifications or Repairs: Riders are not allowed to modify or attempt to repair the jet ski themselves. Any issues should be reported to the rental company.

 

Following these guidelines helps to ensure safety for everyone on the water and prevents damage to the jet ski and surrounding environment.

4. Rental Fees and Payments

4.1. Rental Rates:​

  • Hourly Rate: $150 per hour.

  • Half-Day Rate: $600 (for up to 4 hours.)

  • Full-Day Rate: $1,200 (for 8 hours.)

The rental fees are based on the duration of the rental. Prices are subject to change at any time without prior notice.

4.2. Payment Methods:

  • Payments can be made via credit card, debit card, mobil payments and cash.

  • An additional transaction fee of 4% will be applied plus 7% sale tax will be added to the final price during checkout.

  • Full payment for the rental period is due at the time of booking or prior to use.

  • Credit card pre-authorization may be required for security deposits.

4.3. No Payment, No Service:

  • Failure to complete payment before the rental begins will result in the reservation being cancelled with no guarantee of rebooking.

5. Equipment Return

5.1. Return Time

  • Agreed Time: Equipment must be returned by the time specified in the rental agreement. Late returns may incur additional charges.

  • Early Return: We do not offer partial refunds if the jet ski is returned before the scheduled end of the rental period.

 

5.2. Condition of Equipment

  • Clean and Intact: The equipment should be returned in the same condition as when it was rented. This means no damage, excessive wear, or missing parts.

  • Damage Inspection: Upon return, the rental company typically inspects the equipment for any damage. If damage is found, the renter may be held financially responsible for repair or replacement costs.

  • Fuel Levels: Refueling fees apply if the jet ski is not returned with a full tank of gas.

5.3. Late Return Penalties

  • Overtime Charges: If the equipment is returned late, additional fees may be charged, often based on hourly or daily rates.

  • Loss of Deposit: In some cases, a late return may result in forfeiture of a security deposit.

5.4. Report Issues

  • Notify of Problems: If the renter experienced any malfunctions or problems with the equipment during the rental period, they should report it to the rental company upon return.

5.5. Liability for Damage or Loss

  • Responsibility for Damage: The renter is usually liable for any damage, loss, or theft of the equipment while it’s in their possession.

  • Insurance: Miami Jet Ski Club rental agreements include insurance or offer it as an option. If insurance was purchased, it may cover some of the damages.

5.6. Final Payment and Deposit

  • Refund of Deposit: If a security deposit was provided, it will typically be refunded after the equipment is inspected and no damages or late fees are found.

  • Additional Charges: Any additional charges (e.g., for damage, refueling, or overtime) will be deducted from the deposit or charged separately.

 

5.7. Proper Docking or Return Location

  • Designated Location: The equipment must be returned to the designated location, such as a dock or rental office, as specified in the agreement. Failure to do so may result in additional charges.

6. Late Fees and Penalties

6.1 Late Fees and Penalties:

  • A penalty of $75.00 USD per every 15 minutes will be applied for any late returns beyond agreed rental period.

  • If the jet ski is returned more than 1 hour late, an additional full hour's rental fee will be charged plus the penalties

6.2 Failure to Notify:

  • If the customer fails to notify the company of a late return, the company reserves the right to charge penalties.

6.3 Extension Requests:

  • Extension must be requested and approved at least 1 hour before the end of the rental period. If the extension is not granted, late fees will apply as per the above schedule.

6.4 Overnight Late Returns:

  • In case of an overnight delay, a full-day rental fee will be charged for each additional day the jet ski is not returned

This policy ensures that customers understand the consequences of returning equipment late, while providing clear information on how fees will be applied.

7. Cancellation Policy

7.1. Standard Cancellations:

  •  Customers must provide a minimum of 24 hours’ notice prior to the scheduled rental time to receive a full refund.

  •  Cancellations made within 24 hours of the scheduled rental time will incur a 50% cancellation fee.

  •  No-shows or cancellations made within 1 hour of the scheduled rental time will result in the full rental fee being charged, with no refund provided.

7.2. Weather-Related Cancellations:

  • If the rental is cancelled due to unsafe weather conditions (e.g., high winds, storms), as determined by the company, customers will have the option to:

  • Reschedule the rental for another available date, or

  • Receive a full refund, regardless of the cancellation notice period.

7.3. Rescheduling:

  • Customers may reschedule their rental up to 24 hours before the scheduled time without penalty, subject to availability.

  • Rescheduling within 24 hours of the rental time will incur a 10% rebooking fee, unless the change is due to weather conditions.

7.4. Late Arrivals:

  • If the customer is late for their scheduled rental time, the rental will still end at the originally agreed-upon time, with no refund or credit for unused time.

  • In cases of more than 30 minutes late without notification, the rental will be considered a no-show and the full rental fee will be charged.

8. Refund Policy

8.1. Full Refunds:

  • Customers are eligible for a full refund if they cancel their booking at least 24 hours before the scheduled rental time.

  • In the case of weather-related cancellations determined by the company, a full refund will be provided, or the customer may choose to reschedule.

8.2. Partial Refunds:

  • Cancellations made between 24 and 1 hour before the scheduled rental time will receive a 50% refund.

  • If the customer returns the jet ski early for any reason (except due to weather), no refunds will be issued for the unused time.

8.3. No Refunds:

  • No-shows or cancellations made less than 1 hour before the scheduled rental time will not be eligible for any refund.

  • Refunds will not be issued for rentals that are cut short due to rule violations, including reckless behavior or operation under the influence of alcohol or drugs.

8.4. Refund Process:

  • All refunds will be processed within 7-10 business days to the original payment method used at the time of booking.

  • Customers requesting a refund must provide proof of booking and identity.

8.5. Non-Refundable Deposits:

  • Any security deposit taken for damages is non-refundable in the event of equipment damage or violations of the rental agreement.

This refund policy clearly outlines when customers can expect a refund, the conditions under which they are entitled to one, and how the refund process works.

9. Indemnification Clause

The renter agrees to indemnify and hold the rental company harmless from any legal claims, damages, liabilities or lawsuits arising from their use of the jet ski.

  • Injuries to third parties caused by the renter's negligence or improper use of the jet ski.

  • Damage to the jet ski or other property while it is under the renter's control.

  • Legal expenses incurred by the rental company in defending against claims related to the rent's actions.

  • Fines, citations or tickets "Miami Jetski Club" is not responsible for any fines, citation, or tickets issued by law enforcements during the rental period. The renter assumes full responsibility for complying with local laws and regulations.

10. Jurisdiction and Governing Law

  • This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Miami, Florida.

These clauses clarify which state or region's laws will apply to the rental agreement and where any legal disputes must be handled.
